Description

In XXXX, my divorce became final and in XXXX I requested to refinance my mortgage loan. The representative told me I can't refinance my loan until after 2 years from the finalization of my divorce. At that time the rates were much lower and I could have refinanced with a lower payment. I lost my job in XXXX, then the Pandemic happened and I wasn't to find employment and I had to file for Chapter 13 Bankruptcy. I'm currently in a Chapter 13 Bankruptcy Plan, my mortgage was modified outside the Chapter 13 Bankruptcy Plan, the Trustee setup the payment plan amount for monthly amounts. Then, the mortgage company mailed me a modification plan attached ( see mortgage loan modification letter attached ) with a much higher amount then what's listed on my attached statements from the mortgage company, which list the payment plan amounts the Trustee setup ( see mortgage statement attached ). I was speaking with my Relationship Manager and he told me the amount on ( see mortgage loan modification letter attached ) is the amount I must pay and at the scheduled time. I couldn't make that payment because it was higher then the amount on ( see mortgage statement attached ) and I was receiving conflicting information from my Relationship Manager. I asked for a forbearance and they declined, when I didn't make the payment they withdrew from the Chapter 13 Bankruptcy, had the stay order lifted and filed for foreclosure with a sell date on XX/XX/XXXX. The Mortgage company is an affiliate of Ocwen Mortgage Services. I'm a XXXX XXXX XXXX XXXX and I don't want to lose my home. I've lived in my home for 25 years and I don't have no family here and no where to live and I don't want to be homeless. I asked the XXXX XXXX from the mortgage for more time to pay the much higher modification amounts and they sent me an email ( see email attached ), the same day stating if I don't make that payment the modification will be declined. I told him this isn't fair because they sent me the morning of the same day they ordered me to make the payment. I want this mortgage company to be investigated for changing the repayment plan amount to a much higher amount then Trustee ordered and to have the sale date canceled and to give me a stay.
