Description
I am submitting a complaint regarding LexisNexis and their inadequate response to my inquiries concerning bankruptcy information reflected on my credit report. On XX/XX/year>, I mailed a certified letter to LexisNexis ( tracking number : XXXX ) requesting clarification on whether the bankruptcy information reported on my credit report was furnished by them. I received a response from LexisNexis, but it did not answer my specific questions. The letter provided only general information regarding the LexisNexis dispute procedure and failed to address whether LexisNexis provides bankruptcy information to XXXX, XXXX, and XXXX. They did not confirm whether bankruptcy information is sent to these credit bureaus or if they report this information to any of the major credit bureaus. Additionally, the letter indicated that for disputes related to bankruptcies, I should reach out to the PACER Service Center. However, the PACER Service Center is not listed as a furnisher on my credit reports, which adds to the confusion and raises concerns about the accuracy of the information provided to me. This lack of a substantive response raises significant concerns regarding LexisNexis 's compliance with the Fair Credit Reporting Act ( FCRA ) and California consumer protection laws. 1. **Failure to Respond Adequately : ** Under the FCRA, consumers have the right to receive accurate and complete responses to inquiries regarding their credit information. LexisNexis 's failure to adequately address my specific questions constitutes a violation of this obligation. 2. **Inaccurate Reporting : ** According to Section 607 ( b ) of the FCRA , entities are required to ensure the accuracy of the information they report. By not verifying or validating whether they report bankruptcy information to the credit bureaus, LexisNexis is potentially perpetuating inaccuracies in my credit report. 3. **California Consumer Credit Reporting Agencies Act ( CCCRAA ) : ** California law mandates that credit reporting agencies maintain accurate and clear reporting practices. The CCCRAA requires timely and complete responses to consumer inquiries regarding credit reporting information. LexisNexis 's lack of a substantive response violates these provisions. 4. **Data Furnisher Requirements : ** As a data furnisher, LexisNexis is obligated under Section 623 of the FCRA to provide accurate information and to investigate disputes regarding the accuracy of the information reported. Their failure to confirm whether they furnish bankruptcy information to the major credit bureaus constitutes a violation of these requirements. 5. **Misleading Information : ** The inclusion of the PACER Service Center as a contact for bankruptcy disputes without clear disclosure that it is not a furnisher on my credit report is misleading and fails to provide the necessary transparency required under both the FCRA and California law.
