Description

When I was married, my ( ex ) husband and I consolidated our loans into a spousal consolidation. He filed for divorce XXXX months later. Our divorce settlement ordered him to be responsible for the debt of the loan. He has failed to pay the loan and deferrred it for multiple years, without my consent. My understanding is that BOTH spouses must qualify for financial hardship. Im a XXXX and make an income that wouldnt have qualified me. My ex either forged my signature or falsified information. Navient never contacted me to verify my income, and deferred the loan multiple times. Now, years later the interest has almost doubled the loan. My ex has stopped making payments. Ive been forced to make the payments for the last 3.5 years. We are on the income based repayment plan and the reduced payment is $ XXXX/month. Im struggling to afford this and also know its only paying the interest on the loan, which is {$160000.00}. My portion of the loan is only {$27000.00}. Im exasperated that Im held responsible for all the interest and that Navient never contacted me to verify my income. They approved the deferement without my consent. This is very wrong. I realize that Navient doesnt care about our divorce agreement. I would like to pay for my share of the student loan and not be responsible for my exes share. This isnt fair! Ive consulted with attorneys, but Id rather communicate directly with the server or government. Please let me know what I can do. Thank you
