Bona Fide Need Rule
Definition
The Bona Fide Need Rule (31 U.S.C. 1502) requires that appropriations be used only for the needs of the period for which they were made. A FY2026 one-year appropriation must fund FY2026 requirements. Severable services (e.g., maintenance) may cross fiscal years if the period of performance does not exceed 12 months.
